Liability Release Agreement

Sherpa Systems – SherpaCart

I hereby acknowledge that I am aware of the risks involved in operating the “SherpaCart,” an electric, remote-controlled 4-wheeled cargo cart designed for a maximum load of 600 pounds, manufactured by Sherpa Systems. In consideration of being permitted to use the SherpaCart, I agree to the following terms and conditions:

  1. Operator Responsibility: I understand and agree that only adults are permitted to operate the SherpaCart in a safe environment. I acknowledge that this cart is not designed or intended for carrying live cargo such as children, pets, or any other animals.

  2. Cargo Handling: I agree not to exceed the maximum weight capacity of 600 pounds. I will not drop cargo from a height greater than 1 foot from the cart bed to prevent potential damage to the cart.

  3. Risk Acknowledgement: I acknowledge that Sherpa Systems is not liable for any damage caused by operator error, including damage to the cart or to the customer’s property during the use of the SherpaCart.

  4. Sobriety: I agree not to operate the SherpaCart under the influence of alcohol or any other substances that impair judgment, similar to the operation of a motor vehicle.

  5. Assumption of Risk: I understand and accept that Sherpa Systems is not responsible for the actions or decisions made by the user while operating the SherpaCart. I assume full responsibility for any injuries to myself or others, as well as any damage caused to property during the use of the SherpaCart.
I hereby release, waive, discharge, and covenant not to sue Sherpa Systems, its officers, employees, or agents from any and all liabilities, claims, demands, or actions arising directly or indirectly from my use of the SherpaCart.
I acknowledge that I have read this liability release agreement, understand its content, and voluntarily agree to its terms.

Refunds & Returns

Thank you for shopping at SherpaCart! We appreciate your business and want you to be completely satisfied with your purchase. If you are not entirely satisfied with your purchase, we’re here to help.

Returns

You have 14 calendar days to return an item from the date you received it. To be eligible for a return, your item must be unused and in the same condition that you received it. Your item must be in the original packaging.

You MUST obtain an RMA (Return Merchandise Authorizaton) from SherpaCart Support (support@thesherpacart.com) prior to sending any return.  We will NOT accept returns without prior authorization.  We may require photographs, video or other documentation of the issue during this RMA process.   Please include your order number and reason for the return in the return package.

Refunds

Once we receive your item, we will inspect it and notify you that we have received your returned item. We will immediately notify you on the status of your refund after inspecting the item.

If your return is approved, we will initiate a refund to your credit card (or original method of payment). You will receive the credit within a certain amount of days, depending on your card issuer’s policies.

Shipping

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
